Terms of Service
Please read these terms carefully before using our platform.

1. Acceptance of Terms
By accessing or using the Maskki platform ("Service"), operated by Maskki, a product of Leader Smart Technology LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including businesses and their authorized representatives ("Customers").
2. Description of Service
Maskki provides an AI-powered conversational agent platform that enables businesses to deploy intelligent chatbots with visual 3D avatars. The Service includes:
- AI conversational agents with natural language processing
- Real-time 3D avatar rendering (client-side)
- Speech-to-text and text-to-speech capabilities
- Knowledge base management and retrieval-augmented generation (RAG)
- Multi-language support including Arabic dialects
- Analytics dashboard and conversation management tools
- API access for integration with third-party applications
⚠️ AI Compliance Notice
Maskki uses artificial intelligence to generate responses in conversations. By using our Service, you acknowledge and agree to the following:
- AI-Generated Content: Responses provided by our AI agents are generated by machine learning models (including large language models) and are not produced by human agents unless explicitly indicated during a human handoff.
- No Guaranteed Accuracy: While we strive for accuracy, AI-generated responses may contain errors, inaccuracies, or outdated information. The Service should not be relied upon for medical, legal, or financial advice.
- Disclosure to End Users: Customers deploying our Service are required to clearly disclose to their end users that they are interacting with an AI agent, not a human. This disclosure must be visible before or at the start of each conversation.
- Content Moderation: Our AI agents are designed with safety filters to prevent harmful, discriminatory, or inappropriate content. However, no system is perfect. Customers must monitor agent interactions and report any issues.
- Data Processing: Conversation data is processed by AI models to generate responses. See our Privacy Policy for details on how data is handled, stored, and protected.
- Training Data: Customer conversation data is not used to train our AI models unless the Customer explicitly opts in to our model improvement program.
- Human Oversight: Customers retain responsibility for monitoring their AI agent's behavior and ensuring compliance with applicable laws and regulations in their jurisdiction.
3. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent.
4. Subscription Plans and Billing
The Service is offered through subscription plans as described on our Pricing page. By subscribing to a plan, you agree to the following:
- Billing Cycle: Subscriptions are billed monthly or annually, depending on the plan selected. Billing begins at the end of any applicable free trial period.
- Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
- Price Changes: We may adjust pricing with 30 days' written notice. Price changes will take effect at the start of your next billing cycle.
- Conversation Limits: Each plan includes a monthly conversation allowance. Usage beyond the plan limit may result in temporary service suspension until the next billing cycle or a plan upgrade.
- Payment Processing: Payments are processed securely through Paddle, our merchant of record. We do not store your full payment card details.
5. Free Trial
We offer a 14-day free trial of the Service with limited conversation credits. The free trial does not require a credit card. At the end of the trial, you must select a paid plan to continue using the Service. Unused trial conversations do not carry over to paid plans.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Transmit harmful, threatening, abusive, or harassing content
- Impersonate any person or entity, or misrepresent your affiliation
- Deploy AI agents that engage in deceptive practices (e.g., pretending to be human without disclosure)
- Use the Service for spam, phishing, or fraudulent activities
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Circumvent usage limits, security measures, or access controls
- Use the Service to develop competing products or services
- Upload malicious content or knowledge base files designed to manipulate AI behavior
7. Intellectual Property
Our IP: The Service, including its software, design, branding, and documentation, is owned by Leader Smart Technology and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
Your Content: You retain ownership of all content you upload to the Service, including knowledge base documents, avatar configurations, and business data. You grant us a limited license to process this content solely for the purpose of providing the Service.
Conversation Data: Conversation transcripts between your AI agent and end users are considered your data. You are responsible for ensuring you have the necessary rights and consents to process this data.
8. Data Protection
We process personal data in accordance with our Privacy Policy. As a Customer, you act as a data controller for end-user data processed through your AI agents, and we act as a data processor on your behalf. Enterprise customers may request a Data Processing Agreement (DPA) by contacting contact@lsmarttech.com.
9. Service Availability and SLA
We strive to maintain 99.5% uptime for the Service. Enterprise customers may negotiate custom SLA terms. We are not liable for service interruptions caused by:
- Scheduled maintenance (with reasonable advance notice)
- Third-party service outages (cloud providers, payment processors)
- Force majeure events (natural disasters, government actions, etc.)
- Your network connectivity or hardware issues
10. Limitation of Liability
To the maximum extent permitted by law, Leader Smart Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Leader Smart Technology, its officers, directors, and employees from any claims, damages, or expenses arising from:
- Your use of the Service or violation of these Terms
- Content you upload or make available through the Service
- Your end users' interactions with your AI agents
- Your violation of any applicable laws or third-party rights
12. Termination
Either party may terminate the subscription at any time. Upon termination:
- Your access to the Service will be revoked at the end of the current billing period
- You may request export of your data within 30 days of termination
- After 30 days, we will delete your data in accordance with our data retention policies
- Refund eligibility is governed by our Refund Policy
We may suspend or terminate your account immediately if you violate these Terms or engage in activities that harm the Service or other users.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Leader Smart Technology is incorporated, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration, unless otherwise required by applicable law.
